HMRC Launch Consultation Paper on Residence Issues
HM Revenue & Customs have released two consultation papers on the Statutory Definition of Non-residence for Taxation Purposes and the Taxation of Non-Domiciled Individuals residing in the UK. The proposals include automatic non-residence status for those who spend less than 10 days in Britain in any tax year.
The existing guidelines are complicated and have evolved in recent years due to repeated challenges through the courts. The aim now is to clarify the current guidelines and bring residence issues on a statutory footing. The consultation process is due to last until 9 September 2011.
